DEED OF ADHERENCE
To the Constitution and Code of Conduct
BETWEEN
Motorsports Kenya Federation (MK-F), the duly recognised National Sports Organisation for Motorsport in Kenya, established and governed under the Sports Act, 2013 and its Constitution ("the Federation");
AND
Applicant
RECITALS
WHEREAS:
A. The Federation is governed by its Constitution, policies, regulations and decisions made in accordance therewith;
B. The Federation has adopted a Code of Conduct setting out the standards of behaviour, ethics, integrity and professionalism expected of all affiliated organisations, office bearers, officials, competitors, volunteers, employees, commissions and members;
C. The Signatory wishes to become, or continue to serve as, an affiliated organisation, official, office bearer, commission member, employee, volunteer, competitor or representative of the Federation;
D. The Federation requires all such persons and organisations to formally undertake to comply with the Constitution and Code of Conduct.
NOW THEREFORE the Signatory agrees as follows:
1. ADHERENCE
I/We hereby acknowledge that I/we have received, read and understood:
The Constitution of Motorsports Kenya Federation (MK-F);
The MK-F Code of Conduct;
All applicable regulations, policies, directives and decisions issued by the Federation from time to time.
I/We agree to be bound by and comply fully with each of the above documents.
2. COMPLIANCE
I/We undertake to:
uphold the objects, vision and values of the Federation;
act honestly, fairly and with integrity;
promote good governance and transparency;
respect fellow members, competitors, officials, volunteers, spectators, sponsors and stakeholders;
comply with all lawful decisions of the Federation;
avoid conflicts of interest and declare any actual or perceived conflicts promptly;
refrain from conduct that may bring the Federation or the sport into disrepute;
comply with all safeguarding, safety, anti-harassment, anti-discrimination and integrity requirements adopted by the Federation;
comply with all applicable laws of Kenya relating to sport and governance.
3. ACKNOWLEDGEMENT OF DISCIPLINARY AUTHORITY
I/We acknowledge that any breach of:
may result in disciplinary proceedings and sanctions in accordance with the Constitution and applicable regulations.
Such sanctions may include, but are not limited to:
warning or reprimand;
suspension;
removal from office;
withdrawal of licences, permits or accreditation;
financial penalties where applicable;
termination of affiliation or membership; or
any other sanction permitted under the Constitution.
4. CONTINUING OBLIGATION
I/We acknowledge that this undertaking is continuous and remains binding for as long as I/we remain:
affiliated to the Federation;
licensed by the Federation;
appointed by the Federation; or
otherwise acting on behalf of the Federation.
Any amendments to the Constitution, Code of Conduct or Federation Regulations shall automatically become binding upon their adoption in accordance with the Constitution.
5. GOOD FAITH
I/We undertake to exercise my/our rights and perform my/our responsibilities in good faith and in the best interests of Motorsport in Kenya.
6. GOVERNING LAW
This Deed shall be governed by and interpreted in accordance with:
the Constitution of Motorsports Kenya Federation (MK-F);
the Sports Act, 2013 of Kenya and all applicable regulations made thereunder; and
the laws of the Republic of Kenya.
